Hüthig GmbH (“the Organizer”)
The following terms and conditions shall apply to the contracts between the Organizer and the individual registrant (“Contract Party”). They apply to the exclusion of any other provision or rule. Deviating terms and conditions are inapplicable.
We recommend to register well in advance. The participation/exhibition fee is payable up until the start of the event at the latest, however not before you receive the invoice.
The Organizer in the fulfillment of its contractual obligations shall be liable only for its own intentional or grossly negligent acts or any such acts committed by its legal representatives and/or agents. The Organizer shall be fully liable in the case of a breach of a fundamental condition of contract, if attributable to slight negligence, however, limited to the reasonably foreseeable damage which is intrinsic to the contract. The liability of the Organizer or its statutory representatives or of its agents for damage related to culpable injury to life, limb or health as well as with respect to their adherence to guarantees promised remains unaffected.
The registration is the basis of the organizer's resource planning. When booking speakers, event rooms, catering, etc., the organizer must decide in good time in order to be able to realize a good quality of the event at reasonable prices. The registration for an event must therefore be regarded as binding. Should a cancellation nevertheless take place, the following cancellation conditions shall apply: Cancellation must be made in writing. For cancellations up to 4 weeks before the event, the organizer will charge 150.00 € +19% VAT for expenses already incurred. For cancellations after this date as well as for non-attendance, fees amounting to 100 % of the regular participation fee plus 19 % VAT must be paid. A substitute participant can be named free of charge. The contractual partner reserves the right to prove a lower damage of the organizer.
The organizer reserves the right to relocate, change or cancel the entire event or individual parts thereof at short notice.
4 Changes in the schedule:
The Organizer reserves the right to change the original schedule in exceptional circumstances. Should the event be cancelled for previously unforeseeable reasons, the Contracting Party shall be informed forthwith. In such a case, the Organizer’s liability shall be limited to paying back the fees already received. Furthermore, Art. 2 shall apply.
5 Sound and image recording:
Audio and image recording during an event shall require the prior written approval of the Organizer. The same shall apply mutatis mutandis for any subsequent use of sound and image recordings made at any event. The Contracting Parties agree that image and sound recordings of their person, made by the Organizer, can be used free of charge.
6 Event documents/documentation:
A third party cannot be granted the right to use event documentation and/or training documents, whether against valuable consideration or not, without the prior written consent of the Organizer.
7 Data protection notice:
Data of the Contracting Party is stored and/or processed within the strict limits imposed by the German Federal Data Protection Act. Data is stored and/or processed solely for the purpose of implementing and accounting for the registration as well as for providing the Contracting Party with information on the range of services offered by Hüthig GmbH.
The contractual partner can object at any time to the processing and use of their personal data for the purpose of providing information about current offers by Hüthig GmbH with effect for the future. 8 Severability clause:
If a provision of this agreement is or becomes wholly or partially invalid, the validity of the remaining provisions of the agreement shall not be affected.
9 Venue/applicable law:
The venue for all disputes arising out of this contract between the Organizer and the Contracting Party shall be the seat of the Organizer, Heidelberg, Germany, provided that the Contracting Party is a business person, a legal person under public law or a special fund governed by public law.
10 Publication of participant lists:
At our events we intend to provide participants with a list of participants including names and positions as well as the names and locations of the participants’ companies. If you do not agree to your details being included in the participant list, please contact firstname.lastname@example.org.
11 Out-of-court online dispute resolution:
The European Commission has set up a platform for online dispute resolution. You will find this here: http://ec.europa.eu/consumers/odr/.
Consumers can use this platform to resolve their disputes. We are neither willing nor obliged to take part in a dispute resolution procedure run by a consumer arbitration body unless we are required by law to do so.
The law applicable shall be the law of Germany.
